Terms of Service

Effective date: July 1, 2026

These Terms of Service (“Terms”) govern your use of babysitter.net (the “Service”), operated by Babysitters Network LLC. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What babysitter.net is

babysitter.net is a neutral online venue that helps families discover and communicate with independent babysitters. We are not a babysitting agency, employment agency, or staffing firm. We do not employ, supervise, screen beyond stated verification badges, or direct the work of any babysitter. We do not select sitters for families, set wages, or guarantee outcomes.

2. Independent contractor relationship

Direct payment disclosure. All child care wages are paid directly to the sitter by the parents. No wages flow through babysitter.net.

Babysitters who use the Service are independent contractors. They are solely responsible for negotiating their own rates, scheduling, performing services, and reporting and paying their own taxes. We do not issue 1099 (US) or T4 (Canada) tax forms to sitters, and we do not withhold taxes on their behalf.

3. Eligibility and accounts

  • You must be 18 or older to use the Service.
  • One account per person. You must provide accurate information and keep it current.
  • You are responsible for safeguarding your password and for all activity under your account.
  • We may suspend or terminate accounts that violate these Terms, harm other users, or are used fraudulently.

4. Acceptable use

  • No harassment, threats, hateful conduct, or discrimination.
  • No false or misleading profile information, impersonation, or fake reviews.
  • No attempts to circumvent paid features (for example, sharing unlocked contact information with non-paying users).
  • No scraping, automated access, or reverse engineering of the Service.

5. Payments and refunds

Parents may post jobs and browse babysitters for free. Messaging a sitter and viewing sitter phone numbers requires either a one-time contact unlock or a Premium subscription. All payments are processed by Stripe. Premium subscriptions renew automatically until canceled in your billing portal.

Because the Service grants immediate digital access (messaging, contact information), all fees are non-refundable except where required by law or at our sole discretion.

6. SMS messaging program

By providing your mobile number and checking the SMS consent box at signup, you agree to receive transactional SMS messages from babysitter.net, including:

  • Phone verification codes
  • Alerts when another user sends you a message
  • Job-match notifications
  • Account and security notifications

Message frequency varies. Message and data rates may apply depending on your mobile carrier and plan. Carriers are not liable for delayed or undelivered messages.

Reply HELP at any time for help, or reply STOP to cancel. After replying STOP you will receive one confirmation message and no further SMS, though you may still receive account emails. To opt back in, contact us at hello@babysitter.net.

See our Privacy Policy for details on how we handle your mobile information. Mobile opt-in data and consent are never shared with third parties for marketing or promotional purposes.

7. User content and messaging

You retain ownership of content you post (bios, photos, job posts, messages), and you grant us a non-exclusive license to host and display it as part of the Service. You are responsible for the content you post. We may remove content that violates these Terms.

7A. Background check verification & annual renewal

Babysitters may earn a Verified badge by completing a background check through one of our approved partners: National Crime Search (NCS) for babysitters in the United States, or Triton Canada for babysitters in Canada. babysitter.net does not perform the screening itself; we rely on the partner’s report to decide whether to award the badge.

The Verified badge is valid for twelve (12) months from the date the partner report is issued. To keep the badge active, babysitters must complete a renewal background check every year through the same approved partners. Sitters who do not renew will lose the Verified badge until a new report is submitted and approved. Renewal fees, if any, are set by the partner and paid by the babysitter.

7B. Canadian residents — PIPEDA notice

If you reside in Canada, your personal information is handled in accordance with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). By creating an account you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy, including its transfer to service providers located outside Canada (for example, our US-based hosting, payment, SMS, and email vendors, and our US background-check partner where applicable). You may withdraw consent, access, or correct your personal information at any time by emailing hello@babysitter.net. Complaints about our handling of Canadian personal information can be directed to the Office of the Privacy Commissioner of Canada.

8. Liability waiver

babysitter.net is a neutral venue for connecting individuals. We do not employ, endorse, or vet the conduct of any user beyond stated verification badges. To the maximum extent permitted by law, we are not liable for the acts, omissions, conduct, or qualifications of any parent or babysitter, for in-person meetings arranged through the Service, or for any injury, loss, or damage arising from such interactions.You agree to use independent judgment, conduct your own background checks and reference checks, and meet new contacts in safe, public settings.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the maximum extent permitted by law, babysitter.net’s total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless babysitter.net from any claim or demand arising out of your use of the Service, your content, or your violation of these Terms.

12. Governing law

These Terms are governed by the laws of the State of [STATE], without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in [COUNTY], [STATE].

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
